Thursday April 14th- Eric King Call-In: Focus on USP Lee & BOP

Eric was tested for COVID-19 yesterday at Grady County Jail and is likely being moved this morning. We believe he will be sent to USP Lee- a maximum security prison where he spent 2 weeks in the segregation unit before being sent to Colorado for his case two years ago. On the way to USP Lee last time, Eric was threatened by white supremacists and told to not go in general population. His life is in danger due to this move.

We are asking you today to contact staff at USP Lee and the Bureau of Prisons and urge them to:

1- Transfer Eric out of USP Lee immediately by dropping his maximum management variable.
2- Not force Eric to choose between the SHU (23-24 hours a day in cell, no books, no phone, no email, no visits) and walking the yard with an active death threat against him. 3- Assess his situation immediately. The threat against his life is already documented. There is no need to prolong this process. Eric has 18 months left and needs to prepare for release, not fight for his life against white supremacists.

Tuesday April 13th- Eric King Call-in Continues- Focus on YOUR Senators

Eric is currently at Grady County Jail in Oklahoma City and we want to keep him there and stop him from being sent to a dangerous situation at USP Lee. Tuesday April 12- Call-in Continues- Focus on BOP

Eric is at Grady County Jail in Oklahoma City and we want to keep him there and stop him from being sent to a dangerous situation at USP Lee.

Today, we are asking you to call/fax and email the Bureau of Prisons staff below and urge them to transfer Eric to an appropriate low or medium security prison so he can finish his sentence and go home to his family and community. The Bureau of Prisons knows what will happen if they send him to USP Lee. We do not accept indefinite placement in segregation as an alternative.  Ask them to remove his management variable and send Eric to a federal prison close to home so he can prepare for release in December 2023.

Week 2 of the call-in campaign for Eric King kicks off today at 8am EST.

As of last night, Eric is still at Grady County Jail in Oklahoma City and we want to keep him there and stop him from being sent to a dangerous situation at USP Lee.

We recounted last week that Eric has already been threatened by white supremacists on the way to USP Lee last time and was walked into an empty chow hall to fight a nazi enforcer at USP McCreary last year. The Bureau of Prisons knows what they are doing by sending him to USP Lee. We do not accept indefinite placement in segregation as an alternative. We demand Eric be transferred to a low or medium security prison and be allowed to finish his time and be released in December 2023.

To that end, we are asking for your solidarity for another week of calling, faxing and emailing various Senators and BOP staff. We added Missouri Senators Blunt and Hawley on Friday (that is where Eric was born, raised and lived until his 2014 arrest). Struggle for Native Prisoners’ Rights at Federal Prison in Adelanto

Oso Blanco, other Native Prisoners, campaigning for their rights

A campaign was recently launched on behalf of indigenous political prisoners at the US Penitentiary Victorville in Adelanto CA, and their right to engage in their religious ceremonies and practices, especially the restoration of their sweat lodge, which had been destroyed and desecrated by prison authorities.

In response, there have been some developments regarding Oso Blanco (Byron Shane Chubbuck), a Native political prisoner recognized by the Jericho Movement, who is incarcerated there. His outside supporters have been instrumental in the campaign.

Here are some recent developments:

–USP Victorville has been on lockdown since March 24th due to two deaths (OD’s) that are being investigated. Prison staff are responsible for bringing those drugs into the facility.

–Oso Blanco (OB) is currently in administrative segregation. In accordance with his personal beliefs, he does not use or distribute drugs. Prison staff and administration know this.

–OB was not directly informed why he was placed in segregation. But he was placed in administrative segregation following an exchange with Chaplain Doran Kelvington in which OB calmly advocated for peaceful resolution of the issues around rebuilding the sweat lodge.

–AW Lepe came and told OB on March 29th that a couple people including the pipe holder, Larry, will start cleaning up the sweat lodge area.

–Lepe stated that he will be sure to get the willows himself, he will not wait for the chaplain to do this.

–OB also told Lepe that grass is needed surrounding the area due to the intense heat. It is dangerous to step on the ground/dirt barefoot. Shade is also needed so that no one is at risk for heat stroke which could be fatal.

USA v Jessica Reznicek: fighting the criminalization of water protectors- April 19th

April 19th marks Jessica’s 250th day of being locked up and separated from the people and places she loves. To punish Jessica for protecting our waterways and the climate, the federal government has walled Jessica off from the wind, the rain, the rivers, the sun, and all of us. To mark this day, show solidarity, and explain the significance of her case we will be hosting a webinar that we encourage you all to attend.

The webinar, USA v Jessica Reznicek: fighting the criminalization of water protectors, will highlight the people fighting back against the criminalization of climate action in the United States.

Since the No-DAPL movement, dozens of states have passed critical infrastructure laws that increase criminal penalties for anyone taking action against destructive fossil fuel projects. In 2017, 80 Republicans and 4 Democrats asked the Justice Department to prosecute Jessica Reznick and the valve turners as terrorists. Last year, the justice department answered the call and applied a terrorism enhancement to Jessica’s case, doubling her sentence.

Day 5 of Eric King call-in

!Today is day 5 of our call-in campaign for Eric King. We are going to switch it up and focus on Missouri Senators today (and BOP). As you know, Eric is from Missouri and that is where his case originated so we are going to bring our concerns to the two Missouri Senators.

Remember, Eric is currently in Grady County Jail in Oklahoma City and en route to USP Lee, which is a maximum security prison. Eric should not be going here for two reasons:

1- a management variable was placed on him at FCI Englewood and has not been removed yet. This should be done ASAP.

2- Threats were made against Eric at USP Atlanta from white supremacists who told him he would be killed at USP Lee if he walked the yard.

We are asking the Senators to inquire to the BOP why Eric is being sent to this maximum security prison when his point total is much lower and he only has 18 months left on his sentence. Also, the BOP has already documented the threat against Eric. What point is there sending him to USP Lee when it is well known he would be placed in a dangerous situation? Staying in a miserable segregation unit for the remainder of his time with no access to phone, visits, emails, books and access to his loved ones and legal teams is NOT an alternative.

Sample letter (please use as a basis but change the language)

Dear Senator,
I am writing regarding a friend of mine who is a prisoner in the Federal Bureau of Prisons that is from Missouri. His name is Eric King, Register Number 27090-045. He was most recently on writ in the U.S. District of Colorado for a trial, of which he was found not guilty on all counts. Eric was moved from FCI Englewood and is in transit right now. As of today, he is being held in a private facility- Grady County Jail in Oklahoma. He has been told he is en route to a maximum security prison in Virginia: USP Lee.

The reason I am writing is because I believe Eric should not be sent to USP Lee. There is an active threat against his life. Before Eric was sent to Colorado, he was held in the Segregation Unit at USP Lee for roughly 13 days. Prior to that, he was at USP Atlanta transit unit and a white supremacist/skinhead gang member told him he would be killed at USP Lee if he was released into general population. This had been documented at USP Lee and it is imperative that he not be put in harm’s way. I am asking that you not send him into a situation that is so dangerous.

The Bureau of Prisons knows this and there is established case law regarding the BOP sending someone into dangerous and life threatening scenarios. ), See, Fitzharris v. Wolf, 702 F.2d 836, 839 (9th Cir. 1983); Gullatte v. Potts, 654 F.2d 1007, 1012-13 (5th Cir. 1981); Roba v. U.S., 604 F.2d 215, 218-19 (2d Cir. 1979).

Additionally, Eric has a maximum management variable that is on his security profile that has him erroneously being sent to a custody beyond his actual security level. He has no pending charges, incident reports and a release date of 12.27.2023. He intends to live with his wife and his two children upon release. I ask that this management variable be removed so that he can be sent to a medium or low custody prison close to home and he can work on release preparations. I fear great harm will come to my friend and I am asking that you intervene and ask the Bureau of Prisons not to send Eric King into harm’s way at USP Lee.

The focus today is the Bureau of Prisons. Eric is in the process of being transferred to USP Lee, a high security prison across the country in Virginia. Eric, who should be placed at a medium security facility, reasonably fears that this move is punitive and that at Lee he will lose access to reading materials and, more importantly, his ability to communicate with his loved ones.

More so, placing him at USP Lee near white supremacists who have already threatened Eric’s life is reckless and he can easily be moved to a medium or low security prison.

We must prevent another incident like the one that occurred at USP McCreary and is documented in Eric’s lawsuit against the Bureau of Prisons, where Eric was marched into the chow hall and forced to fight a nazi enforcer.
